SENATE BILL NO. 87

        A bill to amend the Initiated Law of 1996, entitled

   "Michigan gaming control and revenue act,"

   by amending section 12 (MCL 432.212).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Section 12.  Wagering Tax; Rate; Distribution.

 2         (a) A wagering tax is imposed on the gross revenue received

 3    by the licensee from gaming authorized under this act at the rate

 4    of 18%.

 5         (b) The wagering tax plus all other fees, fines and charges

 6    shall be deposited into the state casino gaming fund in the

 7    department of treasury.  Such tax is to be remitted daily by the

 8    holder of a casino license to the department of treasury by elec-

 9    tronic wire transfer of funds.  All of the ordinary, necessary

10    and reasonable expenses of operating the board shall be deducted

11    from the fund.  The fund shall be distributed periodically in

 1    accordance with the provisions of this act pursuant to a schedule

 2    and methodology which shall be mutually agreeable to the depart-

 3    ment of treasury and the city.

 4         (c) The state casino gaming fund shall be allocated as

 5    follows:

 6         (1) 55% to the city in which a casino is located for use in

 7    connection with the following:

 8         (i) the hiring, training and deployment of street patrol

 9    officers;

10         (ii) neighborhood and downtown economic development programs

11    designed to create local jobs;

12         (iii) public safety programs such as emergency medical serv-

13    ices, fire department programs and street lighting;

14         (iv) antigang and youth development programs; and

15         (v) other programs which are designed to contribute to the

16    improvement of the quality of life in the city.

17         (2) 45% to the state to be deposited in the State School Aid

18    Fund to provide additional funds for K-12 classroom education TO

19    BE USED EXCLUSIVELY TO PROVIDE TECHNOLOGY IN THE CLASSROOM.

20         (d) Funds from this act shall not be used to supplant exist-

21    ing state appropriations or local expenditures.
